Data protection statement in connection with the use of drone technology

Information about how your personal data are processed in accordance with Art.13 GDPR in connection with the use of drone technology for surveying

You have seen one of our documentation and surveying drones or a sign – we would like to inform you about the background:

The creation of terrain models with the help of drones flying over the terrain as well as the documentation of the progress of construction on large building sites is an economical alternative to surveys carried out using conventional GPS technology or the documentation of construction work by hand.

The existing topography is measured and recorded by means of drones flying over the relevant areas and subsequent analysis with the aid of software by our engineers. We focus on previously marked / identified areas of construction sites when doing so.

Art. 13 GDPR requires us to inform you about the possible processing of personal data as follows.

2. Collection and storage of personal data as well as type and purpose and their use

  • The system might temporarily record personal data – image data from the vertical – within the scope of the surveying activities. This is not the aim and purpose of the flying of drones and of the surveying activities carried out and we would like to assure you that we will immediately delete such data!
    The survey is rather aimed at measuring identified areas of the construction site for the purposes of making it possible to complete the work properly and expeditiously. This may be on behalf of a public body or a non-public body.

  • This survey data is collected and recorded for the purposes of
    •    the proper execution of existing orders
    •    taking measurements
    Any personal data or data relating to private areas/property will be immedately anonymised or deleted (cf. Art. 4 GDPR for the definition of terms)

  • The data will always be processed in accordance with Art. 6 (1) (1) (b) GDPR to fulfil the aforementioned purposes for the appropriate execution of the quotation / order and for the mutual fulfilment of obligations arising out of the order.

  •  

    The data we collect for the purposes of processing and executing orders will be stored until the statutory obligation to store them expires after which they will be deleted unless we are obliged to retain the data for a longer period of time in accordance with Article 6 (1) (1) (c) GDPR as a result of storage and documentation obligations set out in tax and commercial law (from the Handelsgesetzbuch (HGB – German Commercial Code), Strafgesetzbuch (StGB – German Criminal Code or Abgabenordnung (AO – German Fiscal Code) or you have consented to storage beyond this point in time in accordance with Article 6 (1) (1) (a) GDPR.

3. Forwarding of data to third parties

Your data will not be transferred to third parties for purposes other than those listed below.

  • Your personal data will be forwarded to third parties if such forwarding is necessary for your inquiry / order to be processed in accordance with Art. 6 (1) (1) (b) GDPR.
  • Processing may – e.g. in the case of persons in the surveying / aerial area – also be carried out on the basis of Art. 6 (1) (1) (f) GDPR (legitimate interest / weighing of interests).
  • Any data beyond the construction site / survey / documentation area will not be forwarded under any circumstances.

4. Data subject rights

You are entitled

  • in accordance with Art. 7 (3) GDPR to revoke consent you have provided to us at any time. That will have the consequence that we may in future no longer continue the processing of data that had been based on your consent;
  • in accordance with Art. 15 GDPR to request information about your personal data we have processed. This information shall also include the categories of recipients to whom this data is being forwarded and the purpose and duration of storage;
  • in accordance with Art. 16 GDPR to demand the immediate correction of incorrect personal data that we have stored or the completion thereof;
  • in accordance with Art. 17 GDPR to request the deletion of your personal data that we have stored unless processing is necessary for exercising the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for asserting and exercising legal claims or defending ourselves against them;
  • in accordance with Art. 18 GDPR to demand the restriction of the processing of your personal data insofar as you have disputed the correctness of the data, the processing is unlawful but you are refusing to have it deleted and we no longer require the data but you need it for asserting and exercising legal claims or for the defence against such or you have objected to the processing in accordance with Art. 21 GDPR;
  • in accordance with Art. 20 GDPR to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller and
  • in accordance with Art. 77 GDPR to complain to a supervisory authority. You may usually contact the supervisory authority at your usual place of residence or workplace or our company headquarters.

 

5. Right of objection

Insofar as your personal data is collected on the basis of legitimate interests pursuant to Article 6 (1) (1) (f) GDPR, you are entitled to object to the processing of your personal data in accordance with Article 21 GDPR insofar as there are grounds for doing so which result from your particular situation.
